Form W-8BEN is one of the most commonly requested forms for foreign individuals doing business with US companies. It certifies that you are not a US person and may qualify for reduced withholding rates under a tax treaty.
When do you need a W-8BEN?
You'll be asked to provide a W-8BEN when:
- •A US company pays you for services (freelancing, consulting)
- •You receive dividends from US stocks
- •You receive interest from US bank accounts or bonds
- •You receive royalties from US sources
- •Any US entity needs to determine your tax status
Who provides W-8BEN to whom?
You (the foreign individual) provide W-8BEN to the US entity paying you. It's not filed with the IRS directly — the US entity keeps it on file and may submit it with their own tax filings.
Key fields
Part I — Identification
- •Line 1 — Name. Your legal name as it appears on your passport or ID.
- •Line 2 — Country of citizenship. Your citizenship, not where you live.
- •Line 3 — Permanent residence address. Your home address in your country of residence.
- •Line 5 — US taxpayer identification number. Your SSN or ITIN, if you have one. Not required for all situations.
- •Line 6 — Foreign tax ID. Your tax ID in your country of residence (e.g., T.C. Kimlik No for Turkey, NIF for Spain).
- •Line 7 — Reference number. Optional. The paying entity may assign you a reference number.
- •Line 8 — Date of birth. Required.
Part II — Tax Treaty Benefits
If your country has a tax treaty with the US, you can claim a reduced withholding rate:
- •Line 9 — Treaty country. The country under whose treaty you're claiming benefits.
- •Line 10 — Special rates and conditions. The specific treaty article, rate, and type of income.
Example: A Turkish citizen earning freelance income from a US company could claim benefits under Article 14 (Independent Personal Services) of the US-Turkey tax treaty, potentially reducing withholding from 30% to 0% on certain service income.
Part III — Certification
Sign and date the form. A W-8BEN is valid for 3 years from the date of signing (through December 31 of the third year).
Common mistakes
- •Not claiming treaty benefits. Many people leave Part II blank, missing out on reduced withholding rates.
- •Using the wrong form. Entities should use W-8BEN-E, not W-8BEN.
- •Expired forms. If your W-8BEN is more than 3 years old, the paying entity must withhold at 30%.
